Bye-laws of Elliswick Lawn Tennis Club

  1. These Bye-laws are made by the Board of Elliswick Lawn Tennis Club (the Club) in accordance with Article 52 of the Club’s Articles of Association (the Articles). Capitalised terms in these Byelaws shall have the meaning given to them in the Articles.

Management

2.1       The Board comprises Directors elected or appointed to the following positions:

  • President
  • Chairman
  • Company Secretary
  • Treasurer
  • Grounds Officer
  • Ladies’ Captain
  • Men’s Captain
  • Mixed Team Captain

2.2       Without derogation from the powers of the Directors under the Articles, the Club shall be managed by a committee (the Committee) consisting of the Directors and those Members appointed to the following positions by the Directors, if possible after a vote in favour by the membership of the Club in General Meeting:

  • Junior Secretary
  • Membership Secretary
  • Head Coach
  • Club Administration Officer
  • Club Welfare Officer
  • Tournament Secretary
  • Social Secretary

2.3       An individual Member may fill more than one of the positions listed in Byelaws 2.1 and 2.2 as a Director and/or Committee member but shall only have one vote as a Director or as a member of the Committee.

2.4       The provisions of Articles 5 to 16 shall apply to the Committee as if it were the Board.

2.5       All members of the Committee shall be entitled to be indemnified by the Club in accordance with Article 48 as if a Director.

Members

  1. Members of the Club shall comply with and uphold the LTA Rules, the LTA Disciplinary Code, the Club’s Safeguarding Policy and the Club’s Etiquette Rules . The Committee, or a sub-committee appointed by the Committee, shall take disciplinary action against any Member acting in breach of the Articles or these Bye-laws or where the interests of the Club so require, which may include suspension or termination of membership of that Member.

Membership and Subscriptions

4.1       The entrance fee and annual subscription for each type of Member shall be determined from time to time by an annual general meeting following proposals from the Committee.

4.2       The Members shall pay any entrance fees and annual subscription fees set following the annual general meeting.

4.3       No candidate who has been accepted as a Member shall be entitled to the privileges of membership until they have paid the entrance fee (if required) and their first annual subscription.

4.4       Any Member whose entrance fee or subscription is not paid by such date as the annual general meeting shall decide each year shall be deemed to have resigned their membership of the Club.

4.5       As the Club has limited facilities, it is necessary to regulate how many members it has, to enable it to carry out its objectives of providing facilities for, and promoting participation in, tennis. The Committee shall decide the maximum numbers to be admitted to each category of membership. The Club will maintain a waiting list of applicants for membership. Members will be admitted from this list in chronological order only. For example, the Club will not select members from the waiting list on the basis of sporting ability or whether their membership is supported by another member.

Purchase and supply of liquor

5.1       Purchase for the Club and supply by the Club of intoxicating liquor must be in the absolute discretion of a sub-committee of not fewer than four members of the Club appointed by the  Committee for that purpose of whom the majority must be members of the Committee.

5.2       If any member of the sub-committee for any reason ceases to be a member of the Committee, they automatically cease to be a member of the sub-committee, and another member of the Committee must be appointed in their place.

5.3       The sub-committee must not in any way be restricted in freedom of purchase.

5.4       Persons under the age of 18 years are not to be supplied with intoxicating liquor. The supplying of intoxicating liquor shall be restricted to Members and bona fide guests of 18 years and over.

5.5       The permitted hours for the supply of intoxicating liquor shall be those in force in the district at the time. A Member must be present when the bar is open.

Commission

6.1       No one may at any time receive at the expense of the Club or any Member any commission, percentage or similar payment on or with reference to purchases of equipment, supplies or intoxicating liquor by the Club.

6.2       No one may directly or indirectly derive any monetary benefit from the supply of intoxicating liquor by or on behalf of the Club to Members or guests apart from any benefit accruing to the Club as a whole and apart also from any benefit which a person derives indirectly by reason of the supply giving rise to or contributing to a general gain from the carrying on of the Club.

Guests

7.1       Any Member may introduce guests to the Club, provided that no one whose application for membership has been declined or who has been expelled or suspended from the Club may be introduced as a guest.

7.2       The Member introducing a guest to play tennis must enter the name and address of the guest together with his own name in a book which must be kept on the Club’s premises. At the same time the required visitor’s fee must be paid.

7.3       No one may be admitted as a guest to play tennis on more than three occasions in any calendar year. The total number of guests permitted per Member per annum shall be four.

7.4       Members of other tennis or table tennis clubs attending the Club to play matches are not guests for the purposes of these Byelaws.

7.5       All those playing table tennis at the Club shall be playing or social Members or shall pay a visitor’s fee to be fixed by the Committee on each occasion that they attend to play table tennis unless they belong to a visiting team. Any visitor must be accompanied by a Member.

7.6       All those playing bridge at the Club shall be playing or social Members or shall pay a visitor’s fee to be fixed by the Committee on each occasion that they attend to play bridge. Any visitor must be accompanied by a Member.

Opening of Club premises

8.1       The Club is open for play between sunrise and sunset on each day or at such other times or for such other periods as the Committee shall decide although play is not permitted before 8:00am and after 9:30pm.
